The Public Comment period for the Propoed Rule to Leasing of Osage Reservation Land for
Oil & Gas Mining has been reopened until November 18, 2013. Any public comments
received between October 28 and November 18 will be considered by the Department.
On October 14, 2011, the United States and the Osage Nation (formerly known as the Osage Tribe) signed a Settlement Agreement to resolve litigation regarding alleged mismanagement of the Osage Nation’s oil and gas mineral estate, among other claims. As part of the Settlement Agreement, the parties agreed that it would be mutually beneficial to address means of improving the trust management of the Osage Minerals Estate. Settlement Agreement, Paragraph 1.i. During settlement negotiations it became apparent that review of the existing regulations is necessary to better assist the BIA in managing the Osage Mineral Estate. Settlement Agreement, Paragraph 9. Based on these circumstances, and in accordance with 5 U.S.C. § 563, the Director of the BIA determined that there is a need for a negotiated rulemaking.
On April 2, 2013, the Negotiated Rule Making Committee voted to approve and transmit a package of proposed revised regulations to 25 C.F.R. Part 226 to the Department of the Interior for consideration. At this time, the public comment period has concluded. The Designated Federal Officer will transmit the package of proposed regulations approved by the Committee to the Department.
Once the Department receives the materials from the Designated Federal Officer, the proposed revised regulations will be reviewed and changes may be made during this process to meet formatting, statutory and other legal requirements. The Department will then publish PROPOSED Revisions in the Federal Register. At that point, as required by the Administrative Procedures Act, the public will be able to submit written comments that will be considered by the Department. After the written public comment period ends, the Department will again review the proposed rule and can make additional changes before publishing a FINAL rule.
