Notice to Trust Landowners

The deadline for landowners to contact the Wind River Agency is NOVEMBER 26, 2026.

Negotiated Lease Guidelines

The American Indian Agricultural Resources Management Act (25 U.S.C. 3707-3715) permits approval of a negotiated lease when the majority of interest owners agree to the lease terms and provisions. Landowners of these tracts can contact the Agency for assistance or information needed to negotiate a lease with a lessee of your choice.

Lease Approval Requirements

If a negotiated lease is deemed acceptable and the required percentage of owner consent is obtained, the lease will be approved according to 25 U.S.C. 3715. Consent requirements can be viewed here: 25 CFR 162.012

As trustee, the Agency is responsible for the conservation and protection of trust resources. If no acceptable negotiated lease is submitted within 90 days from the date of this notice, the superintendent may advertise these tracts of land for lease. If a suitable bid is received and a lease is prepared, the lease will be approved under the Act of July 8, 1940 (54 STAT. 745 and 25 U.S.C. 380), along with the regulations at 25 C.F.R. 162.209(b)(1).

Notice of Appeal

If an acceptable lease is prepared and approved from an advertised lease sale, you have the right to appeal the decision. Appeals must be submitted in accordance with 25 C.F.R., part 2. Your notice of appeal should clearly state which decision is being appealed.

Appeal Submission Instructions

Send copies of your appeal to:

1. The Deciding Official (usually the Regional Director)
2. Each interested party known to you
3. This agency
4. Your notice of appeal must certify that you have sent copies to all interested parties.
5. Appeals must be filed within 30 days after the date of lease approval; otherwise, the decision becomes final for the Department.

You may request information from the Agency at any time regarding the date of lease approval.
