Gaming Land Decisions

Office of Indian Gaming

This is not an exhaustive list of all Gaming Decisions in process. It is being continuously being updated as office information is received.

Overview of Gaming Land Eligibility

Indian tribes may only game on Indian lands that are eligible for gaming under the Indian Gaming Regulatory Act. Such lands must meet the definition of “Indian lands” at 25 U.S.C. § 2703, which requires that the land be within the limits of a tribe’s reservation, be held in trust by the United States for the benefit of the tribe or its member(s), or that the land be subject to restrictions against alienation by the United States for the benefit of the tribe or its member(s). Additionally, the tribe must have jurisdiction and exercise governmental powers over the gaming site.

The IGRA, 25 U.S.C. § 2719, contains a general prohibition against gaming on lands acquired into trust after October 17, 1988 (the date the IGRA was enacted into law). Tribes may game on such after-acquired trust land if the land meets one of the exceptions laid out in § 2719. Below are the fee-to-trust decisions and two-part secretarial determinations issued by the Department for after-acquired land for gaming.

Colville Tribes Fee-to-Trust and Casino Project, Franklin County, Washington

Environmental Impact Statement

The Bureau of Indian Affairs (BIA) has initiated the preparation of an Environmental Impact Statement (EIS) to analyze the potential environmental consequences of the Confederated Tribes of the Colville Reservation (Colville Tribes) proposed Fee-to-Trust and Casino Project in the City of Pasco, in Franklin County, Washington. The Proposed Project includes the placement of approximately 160 acres of fee land in trust by the United States upon which the Colville Tribes would construct a casino resort. The facility would include an approximately 184,200-square-foot casino, 200-room hotel, an event center, eateries, and supporting facilities. The proposed trust property is comprised of one parcel (APN 113-130-068) bound by N. Capitol Avenue to the west, commercial and industrial development to the west and south, and agriculture to the north and east. The federal actions necessary to implement the proposed project trigger the requirements of the National Environmental Policy Act (NEPA). The BIA will serve as the EIS Lead Agency for compliance with NEPA.

Scoping Comment Period: April 3, 2024 – June 3, 2024
A Notice of Intent (NOI) for the EIS was published in the Federal Register on April 3, 2024. The NOI described the Proposed Action and announced the initiation of a formal public scoping process, which concluded on Monday, June 3, 2024. A public scoping meeting was held virtually on Wednesday, April 24, 2024. A recording of the public hearing is available here. A scoping report has been made available at this website that summarizes the EIS scoping process, the proposed alternatives, and the issues identified during the scoping comment period.

*Note: A typo in Section 1.2 of the scoping report regarding the publication date of the NOI in the Tri-City Herald was found. The typo has been corrected, the Affidavit of Publication is in Attachment 3 and corrected Scoping Report has been uploaded to this site.

The proposed project includes the placement of approximately 74 acres of fee land in trust by the United States upon which the Tribe would construct a casino resort. Additionally, the Tribe proposes to develop a 20,000-sf cultural center/museum. The proposed trust property is comprised of two parcels (APN 11810101100 located 11810101102) directly north of Interstate 5 (I-5), west of the Marvin Road NE/ I-5 interchange, south of Britton Parkway NE, and east of commercial development in Sections 10 and 11, Township 18 North, Range 1 West, Willamette Meridian.
